    Fare-dodger assault man charged

    A passenger who threw a suspected fare-dodger off a train in Scotland has been charged with assault, British Transport Police have said.

    Alan Pollock nicknamed 'Big Man' is seen in viral mobile phone footage manhandling 19-year-old Sam Mains during an altercation between the Falkirk youth and the ticket inspector.

    Mr Mains was then pushed head-first onto the platform - receiving cuts to his face and bruises.

    British Transport Police said in a statement: "We can now confirm that a 35-year-old man from Stirling and a 19-year-old man from Falkirk are the subject of a report to the local Procurator Fiscal in connection with an incident on-board the 21:33 Edinburgh Waverley to Perth service, at Linlithgow on Friday 9 December 2011."

    At first, the 'Big Man' was hailed a 'hero' by many for tackling Mr Mains, while others criticised his heavy-handed response.


    Student Sam Mains also faces prosecution after he was reported under section 38 of the Criminal Justice and Licensing Act Scotland, which covers threatening and abusive behaviour, and with trespass. He has yet to be formally charged.

      assaults . when my wife was push and assaulted she was 68 at the time , a cut leg and she was very up set the sussex police were called we were told by the police the custody sgt would not charge him , it would not be worth the time, so it looks to me you have to get on tv to get the police to charge people , nice to know old age pensioners are not worth it in the sussex police eyes.ps. the person who did it is a well known bas-----ted in my area.

        If something like this happens then get all the information as to names of officers,dates,times,etc and contact the IPCC as well as the media and demand to speak to a senior officer.Do not be fobbed off with excuses.

        Im suspicious of anyone suggesting their over 60 and leaving messages on Yahoo? If Im wrong I apologise, but I understand the point you are making and believe this is a 'cuff' that the police reguarly do! I too would be on the phone to IPCC. Josling in the street will never be an assault, but your case seem loke it was. Sounds like the bstard you refer to is so well known that they felt it was going to be too much hassle, and perhaps a little bit of fear. Depends how long ago it was as the law has changed about 10 years ago the custody sgt would not accept a common assault, but it could have been considered an ABH! The fact that she was a pensioner is a massive aggravating factor and so he should have dealt with! Not too late to contact the IPCC!

        Considering what happened to this man I would walk away. I am a social worker and was in Darlington a year ago contracting and caught a youth with screw driver trying to break my car lock lock. I grabbed him and two plastic Policeman came up and wanted to arrest me for assault. I got carried away and used a few choice words on them. They called more police and thankfully an old school sergeant turned up and told me quietly to stop shouting. The plastic cops wanted to give me a caution and as a social worker that would have been game over for my job. the sergeant said no and I walked away. The boy was taken away but I never heard anything more. I guess they just let him go. THIS IS ENGLAND. LAW ABIDING TAX PAYING PEOPLE HAVE NO HUMAN RIGHTS. Its all for minorities thanks to the limp wrist guardian reading PC liberal set.

      He actually asked the ticket collector first if he wanted him off the train, he said yes! the lad thought he was tough talking to the elderly ticket collector, his attitude stunk, if he has dodged a fair he should be charged too

        And this is why the inspector should have arranged for the transport police to be at the next stop. I agree that the young guy was totally out of order. Wonder if the 'big guy' would have acted the same way if it was someone his own size?? Dont think so.

        Actually, it's just Scottish "justice", and you are jumping the gun a bit, because "justice" hasn't been seen through to the end. Never mind though, 1000 comments, and I doubt that many have considered the whole process.

      To balance things up lets hope that Sam Mains is also prosecuted and not wrapped in cotton wool like so many offenders are. I don't understand why it has taken a shorter time for the later offence to be prosecuted when the primary offence by Mains is still awaiting a decision.

        Yeah you're right Ron, the kid should definately pay the £20 penalty for travelling without a valid ticket. I don't know what the sentance for ABH is, but you can't go around assaulting people and think that you won't get punished.

        I agree the conductor was not being physically threatened so force should not have been used ,instead the transport Police should have been called. Although the man was rude for all anyone knew at the time maybe he had paid or perhaps was desperate or mentally ill, you can not have brusers running around stepping in to use force every time there is a conflict.

        I think you will find that incident in Essex just would not happen in the north, for one we don't feel the need to carry knives and two they would get a slap, once stopped a guy getting murdered at aldgate over 100 people on the platform no one helped the guy, i slapped two of them and the rest ran that's the north and south divide for you

      Forget the ticket - Using foul language like that in front of childen should be enough to have you removed. Once asked to leave the train by an offical from the train you should comply or expect a futher response. Perhaps he went a bit far, but a train full of paying people just wanting to get home shouldn't have to listen to that and be held up. Sam Mains could have left then reported the incident to the train company if he felt he was not treated fairly. In future smart phone owners - Dont publish images of people "doing their bit".

      The boy's parent's should be charged with neglect of duty. Just supposing the delightful young person in question had been given the wrong ticket, what would a normal young person do? They wouldn't start swearing at the ticket collector. If that had been my son talking to the ticket collector like that, I'd have given him a thick ear.

      when you see the whole video the "fare dodger" at no time offered to show the other ticket that he allegedly purchased. He was good at using foul language but on all the news clips there was no mention of that! I applaud Alan Pollock in what he did! and think that yet again the wrong person is being penalised. It will make other members of the public think twice before offering assistance in the future!!

      Hoodie hugging at it's worst yet again. The guy was a hero. The youth should be charged, not the good samaritan. British Transport Police should be ashamed of themselves for charging someone who tried to help them.

      If you watch the clip carefully you can clearly see Allan Pollock ask the ticket inspector if he wants him to throw him off the train, to which the ticket inspector says 'yeah'. Therefore one would assume from that, that if the ticket inspector had said No (No I don't need help) no further action would have occurred, , Allan only took action and offered his help only after being given consent?

      Does anyone beleive he was given the wrong ticket? Dont really think I do. If he had been polite and explained the situation he may have got a fair hearing. He should have been kicked off the train just for the language he was using, whether he had a ticket or not. I'm with the big man on this as I am sure most of the people are who are sick and tired of anti social behaviour, about time they got some of their own medicine.

      The 'big man' was the only one with the balls to throw the toe-rag off the train, and now he's been charged with assault, outrageous. If it wasn't for him those passengers would've been sitting in that train till the next day, not to mention the tailback it would've caused with other trains, and the tens of thousand of pounds wasted - just because one diddy of an acne faced toe-rag decides he wants a free ride. Give the 'big man' a medal. The UK's law has went pear-shaped.

      As a recently retired police officer i still find it incredible that time after time the police service and cps / PF shoot thereselves in the foot, this man should recieve an award for what he did, standing up to a little scumbag.... i hope and pray that the court watches the entire video and see poor littte soul for what he is, and throws out the case against the 'big man'

      I hope that every person on that train have provided statements and will support Mr Pollock.

      No wonder the police have such an awful reputation, hang your heads in shame....bloody idiots......

      A pity - although no jury will convict him - as it sends a message to all good people not to help others. Would the 'big man' have been charged if the yobbo without a ticket started slapping the old ticket inspector around a bit and he stepped in? In future I'll do what everyone else was doing in the carriage that evening - cowering behind their newspapers. Pathetic. I look forward to the judge throwing the case out with costs against the police.
