High-risk paedophile who thrust penis against girl, three, is spared jail for breaching court order

A high-risk paedophile who sexually assaulted a three-year-old girl in a supermarket has been spared jail for repeatedly breaching a court order – because it would “crush” him.

Keith Holloway, 65, thrust his exposed genitals against the girl in front of her horrified mum.

He also filmed under the skirts of young women and offered an eight-year-old girl an ice pop, telling her she was “beautiful” and inviting her to use his new shower.

Holloway was hauled before Worcester Crown Court after he admitted breaching a court order banning him from owning a camera.

The court heard he bought a camera phone from Argos and failed to tell his probation officer about the purchase.

It was the fourth time Holloway had breached a sexual harm prevention order imposed after he assaulted the three-year-old girl in 2003.

But Judge Nicholas Cole refused to jail him for his latest breach, saying it was a “minor” offence and because his defence barrister said prison would be “crushing” for him.

Jamie Scott, defending, told the court: “It’s plain immediate custody would have a crushing effect on someone who is obviously a frail and unwell man.”

Holloway was described as a “high-risk” offender and the offence is the fourth breach of the order since it was imposed on September 15, 2017.

Three breaches involved his possession of devices (phone or laptop) with cameras and the most serious involved befriending an eight-year-old girl.

Holloway, of Worcester, failed to tell his offender manager he had bought a new mobile phone fitted with a camera which was discovered during an unannounced visit to his home on July 5 .

Prosecutor Michael Aspinall said Holloway committed sexual offences dating back to 1984 when he sent an obscene article in the post.

In February 2003 he was jailed for more than four years for indecent assault on a female under 16.

In October 2007 he received a nine month suspended sentence for outraging public decency after he took pictures up young women’s skirts.

Holloway was made subject to a sexual offences prevention order for 10-years but breached it in December 2016 when police discovered he had a tablet with a camera facility.

As a result of a further breach Holloway was made subject to a sexual harm prevention order which was due to last until October 15, 2027.

And in March he received another suspended sentence after police found another camera and video phone in his home.

Mr Aspinall said he also befriended a girl of eight and gave her £2 to buy some sweets and also gave her ice pops.

He told the girl’s mother her daughter was “beautiful” and tried to persuade the youngster to take a shower.

Mr Aspinall said: “He told police he did not think it was a breach of the order because the girl’s mother was present. The breaches have been persistent.”

Judge Cole said Holloway had “a history of disobedience to court orders” but this latest breach was “minor”.

He added it would be “unjust” to activate the suspended prison sentence.

Holloway was given a 12-month community order and was fined £1,000 and ordered to pay £350 costs.
