Addict thieves, cop beaters and drug drivers sentenced by magistrates this week

It's the weekend and therefore time for a look at the cases that have recently come before Cornwall's magistrates. Everyone who has been charged with an offence, from the least to the most serious, appears initially before the magistrates.

The most serious cases are then sent to the crown court. If a defendant pleads guilty, they could be sentenced straight away or have the matter put back for a pre-sentence report. If they deny the allegations against them, the case will be adjourned for a trial.

The courts are open to anyone and our reporters attend just like any other member of the public. As most people have jobs and cannot spend their time in court, the media has always acted as the eyes and ears of the public to ensure that justice is seen to be done.

Here's who has been sentenced at the magistrates' court in Bodmin and Truro recently.

Nicola Wright

Age: 52

Kew Close, Newquay

On April 4, 2022, in Newquay, assaulted a man thereby occasioning them actual bodily harm. On the same date also in Newquay had in your possession a weapon designed or adapted for the discharge of a noxious liquid, namely pava irritant spray. On the same date, in Newquay, assaulted a woman thereby occasioning her actual bodily harm.

Suspended sentence for 26 weeks, suspended for 12 months. Compensation: £200.

Joshua Peters

Age: 29

Trecarrell Close, Launceston

On nine occasions between December 31 last year and February 23 this year, stole various food items from Greenaways garage, Launceston, including 10 Nesquick Milkshakes, five Yazoo milkshake, Walls slice, to the value of £43.64. The next day, stole 1kg granulated sugar, three Ginsters pastries, litre litre of milk to a value of more than £300.

On three occasions between February 2 and February 19, also stole various food items from the Co-op store on Launceston's high street including four strawberry Yazoo, two stewing steak, chicken, two gammon steaks, two pork chops, and two chicken Yazoo milkshakes to a value of more than £70.

Community order with 25 drug rehabilitation treatment days.

Paul Crowley

Age: 35

Castle Towers, Conce, Bugle

Possess an offensive weapon in a public place. On July 23, 2023 at Bugle, had with you in a public place, namely a baseball bat.

Community order. 80 hours of unpaid work. Requirement to be completed within 12 months.

David Allen

Age: 43

Laroche Walk, Bodmin

On March 18, on the A390 from Trevorry to Edgcumbe Road, Fowey Cross, Lostwithiel drove a car without a licence. On the same date and road, drove a car after consuming so much alcohol that the proportion of it in your breath, namely 123 microgrammes of alcohol in 100 millilitres of breath, exceeded the prescribed limit.

Eight weeks in prison suspended period for 12 months. Disqualification for 30 months.

Darrell Busby

Age: 51

Trevanion Lodge, St Austell

On July 5, 2023, in St Austell, three counts of assault by beating of three police officers acting in the exercise of their functions as such a worker, by beating them.

18 weeks custody suspended for 18 months. Alcohol abstinence and monitoring for 120 days. 25 days of rehabilitation activity, Compensation £150.

Gary McGill

Age: 61

No Fixed Abode

On November 16, 2023, at The Alchemist Jewellers in Bude with intent to cause a woman harassment, alarm or distress, used threatening, abusive or insulting words or behaviour or disorderly behaviour, thereby causing that person or another harassment, alarm or distress.

The next day, in Belle Vue, Bude, with intent to cause another two women harassment, alarm or distress, used threatening, abusive or insulting words or behaviour or disorderly behaviour, thereby causing that person or another harassment, alarm or distress.

Also on November 9, 2023, at The Crescent in Bude with intent to cause a woman harassment, alarm or distress, used threatening, abusive or insulting words or behaviour or disorderly behaviour, thereby causing that person or another harassment, alarm or distress. On the same date, committed a similar offence in The Beauty Salon on the Strand in Bude.

12 weeks in prison. Banned from entering The Beauty Lounge on the Strand in Bude, banned from entering the Strand and banned from entering the Alchemist Jewellery store in Belle Vue, Bude. McGill also received a Criminal Behaviour Order (CBO) and Sexual Harm Prevention Order (SHPO) in relation to these offences.

Matthew Bryant

Age: 33

St Michaels Rd, Stratton, Bude

On January 14, at Stratton Stores in Bude stole one bottle of Captain Morgans Rum, to the value of £20.89 belonging to Stratton Stores. On January 16 at Bude stole , San Miguel Lager belonging to Co-op Stores.

The next day, stole four bottles of wine, to the value of £48.25, belonging to Sainsbury's in Bude. Also stole various meats to the value of £20, belonging to the Co-op stores. Also on January 17, at the B&M store in Binhamy Road in Bude, stole Vape equipment, to the value of £33.79 belonging to B&M store.

On May 4, stole bottles of wine to the value of £20.75 belonging to B&M stores. On the same day also stole bottles of wine, to the value of £7 belonging to Morrisons.

Fined £120 and ordered to pay £104.14 in compensation.

Graham Michael Smith

Age: 68

Station Road, St Mabyn

The ex-BBC and ITV reporter Smith, who is the chairman of St Mabyn Parish Council, has been ordered to stop contacting his victim or risk being charged with a criminal offence which could carry a prison sentence.

Magistrates granted the order against London-born Smith. It now means that for the next five years he is banned from having any contact whatsoever with his victim, her husband or their children. He is also banned from entering a specified area.

Age: 30

Mickleton Avenue, Birmingham

On September 22, 2023 at Launceston, drove a car on Dutson Road, while under the influence of drugs. On the same day, drove a car without insurance and without a licence.

Benjamin Cooke

Age: 25

Meneage Street, Helston

On October 21, 2023, at Helston drove a motor vehicle on Wendron Streeet, when the proportion of a controlled drug, namely Ketamin, in your blood namely 96 microgrammes, exceeded the specified limit.

Community order. Mental health treatment non-residential patient for 12 months. 10 rehabilitation activity days. 80 hours of unpaid work. Disqualification for 18 months.

Russel Ansary

Age: 35

Noweth Place, Falmouth

On March 1 at Camborne police station when suspected of having driven a vehicle and having been required to provide a specimen or specimens of breath for analysis, failed without reasonable excuse to do so. On the same date, drove a vehicle in Falmouth without a valid MoT certificate in place.

Also on that date, drove a vehicle in Falmouth without any valid insurance in place.

Community order. 80 hours of unpaid work to be completed within 12 months. Disqualification for 18 months.

Stephen Horn

Age: 31

On Monday January 8, at Par had with you, without good reason or lawful authority, in a public place namely in St Andrews Road, Par, an article which had a blade or was sharply pointed, namely a black handled kitchen knife.

Fine: £200.

Steven Channon

Age: 33

The Copse, St Austell

On Thursday March 14 at South Street, St Austell intentionally exposed your genitals intending that someone would see them and be caused alarm or distress. On the same date, in St Austell, assault a woman.

Community order. Mental health treatment for 12 Months. 15 rehabilitation activity days. Compensation: £200. Fine: £200.
