Alec Baldwin shooting: Actor’s daughter defends father as sheriff confirms no-one cleared in probe

Criminal charges could still be filed in the probe into Halya Hutchin’s death, US police have said. The focus of the investigation is on how live ammunition came to be on the set of the movie project where the fatal incident took place.

District Attorney Mary Carmack-Altwies said that “all options are on the table” and that “no one has been ruled out” of potential charges.

Police made the announcement at a news conference in Santa Fe, New Mexico on Wednesday, six days after the movie-set shooting that left the 42-year-old cinematographer dead.

Investigators said that a “lead projectile” was removed from the shoulder of director Joel Souza and that it appeared to be a live round. Actor Alec Baldwin fired the gun that killed cinematographer Halya Hutchin’s on the set of their film Rust.

Santa Fe sheriff Adan Mendoza has said that officers are “not exactly sure of [Baldwin’s] present whereabouts”, although the actor is said to be cooperating with authorities and had not been instructed to remain in New Mexico.

Mr Bladwin has since been sighted in Vermont with family.

Investigators hope a forensic analysis of ballistic evidence will shed light on the events of 21 October, but they have said not to expect answers anytime soon.

“We need to be diligent about the investigation so, should there be charges ultimately filed, they are able to uphold those in court,” Juan Rios, spokesman for the Santa Fe County Sheriff’s Department, told Reuters.

Interviews are ongoing and detectives may need to talk to as many as 50 people, Rios said.

Internal investigation launched

The production of Rust has hired a legal team to conduct an internal investigation into the shooting incident.

“In addition to cooperating with authorities, we hired a legal team from Jenner & Block to conduct an investigation of the events,” said a note sent to the film’s cast and crew members, published by Deadline.

The note adds: “We have stressed that they will have full discretion about who to interview and any conclusions they draw.”

New claims

Nicolas Cage had previously complained about the behaviour of Rust armourer Hannah Gutierrez-Reid when they worked together, it is being claimed.

Cage and Gutierrez-Reid worked together on The Old Way, where it has been reported the armourer was also accused of failing to abide by gun safety protocols. It filmed only two months before Rust.

Stu Brumbaugh, a key grip on the movie told The Wrap that Gutierrez-Reid fired a gun near the cast and crew which caused Cage to burst out in anger. Brumbaugh said Cage shouted: “Make an announcement, you just blew my f***ing eardrums out!”

FBI to inspect evidence

Santa Fe County Sheriff Adan Mendoza told reporters at a news conference today that interviews have been conducted, search warrants executed, and evidence from the scene has been collected and processed.

A search warrant was issued for any camera footage taken at the scene.

Approximately 500 rounds of ammunition, including blanks, have been collected, as well as three firearms, Mendoza said.

According to Mendoza, authorities believe they have in their possession the firearm that was fired by Alec Baldwin, as well as the spent shell casing from the bullet that was fired from the gun.

Evidence will be sent to the FBI crime lab in Quantico, Virginia, for analysis.

Investigation continues

Authorities say they have recovered a lead projectile believed to have been fired from the gun used in the fatal movie-set shooting.

Testing is being done to determine whether the lead projectile recovered from director Joel Souza’s shoulder was fired from the gun — a long Colt revolver — used by Baldwin. Two other guns seized include a single-action revolver that may have been modified and a plastic prop gun that was described as a revolver.

Santa Fe County Sheriff Adan Mendoza said it’s too early to comment on whether any charges will be filed. He also noted that 500 rounds of ammunition — a mix of blanks, dummy rounds and live rounds — were found while searching the set.

The sheriff would not comment on how the rounds got on set.

Investigators said they will also be following up on reports that there were other incidents involving misfires with guns used on the set.

District Attorney Mary Carmack-Altwies said investigators can’t say whether it was negligence or by whom at this point.

Both the sheriff and district attorney said they will not rush to judgment and that more investigation is needed.

Santa Fe County Sheriff Adan Mendoza said that authorities have collected 600 pieces of evidence including three firearms, 500 rounds of ammunition – some believed to be live bullets – and several pieces of clothing and accessories in the ongoing investigation.

Some evidence is being sent to an FBI crime lab for analysis, Mendoza said.

Two crew members on The Old Way told the news network that the 24-year-old fired a gun near the actor on set with no warning, according to key grip Stu Brumbaugh, who says he then asked for her to be dismissed.

“Make an announcement! You just blew my f***ing eardrums out!” Cage screamed in annoyance before walking off set, claimed Mr Brumbaugh.

“She was talking to the stunt coordinator, and she just fired off a round, it sounded (like she fired])at the ground, and that’s when Nick really laid into her. That’s when I said she needs to be let go, she’s the most inexperienced armorer I had ever worked with. I have no idea why she wasn’t let go,” said Mr Brumbaugh.

Another crew member on the film, who asked CNN not to name them, also raised concerns about Ms Gutierrez.

“She didn’t carry the firearms safely. She had pistols tucked under her armpits and was carrying rifles in each hand that were ready to be used in the scene,” the crew member claimed to CNN.

“Firearms were aimed at people. She turned around and the pistols that were tucked under her armpits were pointing back at people.”

Assistant director Dave Halls who handed over the prop gun to Alec Baldwin allegedly admitted that he didn’t thoroughly check it, according to new documents.

Halls allegedly told investigators that typically he would “check the barrel for obstructions,” and then armourer Hannah Reed-Gutierrez “opens the hatch and spins the drum,” before yelling “cold gun” on set.

But before the shooting on 21 October, Halls said he “could only remember seeing three rounds” of dummy bullets in the chamber.

“He (Halls) advised he should have checked all of them, but didn’t, and couldn’t recall if she (Reed-Gutierrez) spun the drum,” the documents state.

After the shooting, Halls said they opened up the gun and found four dummy rounds and one live round.

“He advised he could only remember seeing at least four dummy casings with the hole in the side, and one without the hole,” the documents state. “He advised this round did not have the ‘cap’ on it and was just the casing. David advised the incident was not a deliberate act.”

The armourer on the film Rust, Hannah Gutierrez-Reed, told a detective that she had checked the dummy rounds on set to ensure that they were not “hot”, according to an affidavit released on Wednesday.

Dummy rounds don’t have a primer cap and contain no gun powder. Ms Gutierrez-Reed told detectives that the ammunition was left out on a cart on the set while the crew took a break for lunch.

Assistant director, Dave Halls, then took the firearm from the cart and handed it to Alec Baldwin before the shooting, court papers detailed.

Ms Gutierrez-Reed reportedly told the detective that no live ammunition “is ever kept on set”.

Mr Harris, who is not representing any party in the incident, told the American news network: “It may ultimately boil down to really a question of whether or not the actor was appropriately trained in the use of firearms, and that would fall on the production company, and it might absolve Baldwin of negligence.”

He added that gross negligence likely occurred on the set of the film. He said: “I frankly think that if you have a movie set where you’ve got live ammunition that is intermingled with dummy ammunition and intermingled with blanks, that’s the kind of activity that rises to the level of gross negligence, and I do believe that someone, ultimately, is going to be charged with at least criminal negligence in this case.”

Director Joel Souza spotted in public for first time

Mr Souza was photographed sitting in a car with his hand covering his face while driving through Palo Alto in California.

The 26-year-old posted a screenshot of a positive comment about him on her Instagram.

The comment came from someone who identified themselves as working with the same production company that made the 1999 film Thomas and the Magic Railroad, starring Baldwin as Mr Conductor.

The comment said: “I’d dealt with typing up some pretty goofy celebrity riders in my day but NOT your dad.”

The New Mexico police officer investigating the shooting on the set of Rust has said he is “not exactly sure of [Alec Baldwin’s] present whereabouts”.

While Santa Fe sheriff Adan Mendoza said he didn’t know the exact location of the 63-year-old actor, Baldwin is said to be cooperating with authorities and had not been instructed to remain in New Mexico.

The film’s producers have hired the law firm Jenner & Block to investigate the shooting. They have said the lawyers “will have full discretion about who to interview and any conclusions they draw”.

Baldwin reportedly travels to New England to be with family

TMZ obtained photos of Baldwin with members of his family in what the site described as an “off-the-beaten-path location”.

Alec Baldwin on Wednesday retweeted an article on the fatal shooting on the set of Rust that claimed an assistant director told investigators he should have inspected the gun he handed to the actor more closely.

A New York Times article cited an affidavit that said Dave Halls, an assistant director on the film, told a detective that he should have inspected each round in each chamber of a gun he had handed to Mr Baldwin.

He had declared the gun to be “cold,” referring to an industry term that means that the weapon is not loaded with ammunition.

Earlier the 63-year-old actor had retweeted a Variety article, citing the affidavit, that said he was told the gun he was handed was safe.

In an appearance on NBC’S Today show, Santa Fe County Sheriff Adan Mendoza said that one of the principal lines of inquiry was how and why the live rounds came to be on the set.

It is believed that the production of the upcoming movie Rust did not require the use of real ammunition.

“I think during the interviews, the focus of the investigation is how the live rounds got there, who brought them there and why they were there,” said Sheriff Mendoza.

“As far as if it’s going to rise to the point of negligence or the point of criminal charges, we’re hoping to work with the district attorney in reference to that so it’s a clear determination if charges should be filed,” he added.

Weapons armorer Bryan W Carpenter told Fox News that when using reproduction period guns from the Western era, no modification is required to fire blanks.

“The guns from the 1800s are all mechanically operated. Meaning you have to do something each time to make the cylinder rotate and the gun fire. In the case of Alec Baldwin’s gun that he used on this set… you would have to physically cock the hammer back with your thumb each time you wanted it to fire and then pull the trigger. Then cock the hammer back and then pull the trigger each time. It’s done manually.”

He added:

“Now they said that one of those guns on the table that they recovered may have been the same gun modified. My best guess is they just had one that was a true replica, like a prop gun, one made out of metal, and one made out of all plastic.”

Mr Carpenter said there was “some complacency” on set regarding how weapons were handled and he was stunned at reports that live rounds were mixed with dummies and blanks.

He added that firearms on set need to be locked away and watched at all times and no one is allowed to touch them for any reason other than when they are used in filming.

Mr Carpenter stressed the importance of safety checks:

“There should never be a thought that there’s a live round in there. When you’re checking for blank rounds, you’re always looking for the possibility of anything else being there. You lock the weapons in the safe when they’re not in use and they must stay there. Those guns cannot be used for anything else. Everything is separated. Every time that lock is open, you check and check again. And at a minimum, two people should be present to verify that the weapon is in the condition that you say it is.”
