‘The notch’ in the screens of Apple iPhone devices has become notorious – a cutout in the top of the phone’s screen to house front-facing cameras.

Many phone users moan endlessly about the notch in Apple and rival device screens – but one woman has taken her gripe a bit further.

Courtney Davis has filed a complaint saying that Apple’s marketing is misleading, because in promotional images, the notch is blended almost invisibly into the screen.

Davis claims in a complaint filed in the Northern District of California that she was misled into believing that the iPhone XS Max she ordered would not have a notch.

The complaint says, ‘Images that disguise the missing pixels on the Products’ screens are prominent on Defendant’s website, as well as in the advertisements of retailers who sell the products.

‘These images were relied on by Plaintiff DAVIS, who believed that the iPhone XS and XS Max would not have a notch at the top of the phone.’

The lawsuit is seeking class-action status, Business Insider reports – and may take years to come to court.
