Dangerous drivers and woolly hat thief among criminals sentenced by magistrates
It's the weekend and therefore time for a look at the cases that have recently come before Cornwall's magistrates. Everyone who has been charged with an offence, from the least to the most serious, appears initially before the magistrates.
The most serious cases are then sent to the crown court. If a defendant pleads guilty, they could be sentenced straight away or have the matter put back for a pre-sentence report. If they deny the allegations against them, the case will be adjourned for a trial.
The courts are open to anyone and our reporters attend just like any other member of the public. As most people have jobs and cannot spend their time in court, the media has always acted as the eyes and ears of the public to ensure that justice is seen to be done.

Here's who has been sentenced at the magistrates' court in Bodmin and Truro recently.
Sorin Zanoschi
Age: 28
Fore Street, Pool
Cause serious injury by careless / inconsiderate driving, Contrary to section 2C of the Road Traffic Act 1988 and Schedule 2 to the Road Traffic Offenders Act 1988. On September 1, 2023 at Redruth caused serious injury to a man by driving a mechanically propelled vehicle on Tolgus Place without due care and attention.
Community order. Mental health treatment: 12 days. Unpaid work: 200 hours. Obligatory disqualification: 12 months.

Age: 40
Cranmere Court, Rochester
Drive motor vehicle with a proportion of a specified controlled drug above the specified limit, Contrary to section 5A(1)(a) and (2) of the Road Traffic Act 1988 and Schedule 2 to the Road Traffic Offenders Act 1988. On May 5 at Newquay drove a motor vehicle on Alexandra Court, when the proportion of a controlled drug, namely Delta-9-Tetrahydrocannabinol (THC), in your blood, namely 6.1 micrograms per litre of blood, exceeded the specified limit
Possess a controlled drug of Class B - Cannabis / Cannabis Resin, Contrary to section 5(2) of and Schedule 4 to the Misuse of Drugs Act 1971.. On May 5 at Newquay had in your possession 190.7 grams of cannabis, a controlled drug of class B in contravention of section 5(1) of the Misuse of Drugs Act 1971.
Community order. Curfew with electronic monitoring: 12 weeks. Obligatory disqualification: 15 months.

Age: 53
Wesley Street, Camborne
Theft in dwelling other than an automatic machine or meter. On November 28, 2022 in Bournemouth stole items of jewellery, of a value unknown, belonging to a woman.
Community order. Rehabilitation activity: 20 Days. Unpaid work: 150 Hours. Compensation - Compensation: £200.

Age: 34
Minorca Lane, Bugle
Make a false statement to obtain insurance. On March 6, 2023 at Bugle for the purpose of obtaining the grant of a certificate of insurance under Part VI of the Road Traffic Act 1988 to yourself, made a false statement in that you stated you had a full EU Driving Licence with no motoring convictions, using the vehicle for Social Domestic pleasure and commuting to a permanent place of work and kept the vehicle garaged each night.
Similarly on April 9 this year for the purpose of obtaining the grant of a certificate of insurance under Part VI of the Road Traffic Act 1988 to yourself, made a false statement in that you gave an incorrect address for the purpose of reducing the price saying the address the vehicle was kept at was 18 Springfields, Bugle, PL268SJ, which was untrue. You also declared you were unaware of any pending prosecution or police enquiry despite being under investigation for causing serious injury by driving without undue care and attention. You also declared that you had not had any motor insurance policy cancelled, when that was untrue. You also stated you were single when you are married with children.
Community order. Unpaid work: 225 hours. Disqualification period: 12 months.

St Claire Street, Penzance
Harassment - breach of a restraining order on conviction. On October 29 in Plymouth without reasonable excuse, you contacted a woman which you were prohibited from doing by a restraining order under section 360 of the Sentencing Act 2020, imposed by Cornwall Magistrates Court on 21/06/2021.
Suspended sentence order: 8 weeks suspended for 18 months. Rehabilitation activity: 20 days.
Emily Carhart
Age: 46
Hawkins Road, Newquay
Possess a controlled drug of Class A - Cocaine. On April 2 in Redruth had in your possession 0.06 grammes of cocaine a controlled drug of class A in contravention of section 5(1) of the Misuse of Drugs Act 1971.
On the same day in Chacewater had with you, without good reason or lawful authority, in a public place an article which had a blade or was sharply pointed, namely a large kitchen knife.
Community order. Mental health treatment: 12 Months. Rehabilitation activity: 12 Days. Forfeiture order (other than vehicle) - Property to be forfeited: large kitchen knife and of the cocaine.

Age: 21
The Beacon, Falmouth
Theft from a shop. On September 25 in Church Street, Falmouth stole a woolly hat, of a value £26.99, belonging to Ann's Cottage. Also on August 30 at in Cliff Road, Falmouth stole two disposable BBQ's, of a value £6, belonging to The Co-op store.
Community order. Rehabilitation activity: 10 Days. Compensation: £6.
