DeAndre Baker, cornerback for the New York Giants, has been charged with four counts of robbery with a firearm after allegedly robbing a Miami-area party in May.

Seattle Seahawks defensive back Quinton Dunbar, who was also arrested for the same crime, is not being charged due to “insufficient evidence.”

Baker, 22, and Dunbar, 28, were both put on the commissioner’s exempt list last week.

Baker, Dunbar surrendered to police in May

The alleged crime happened in mid-May, when Baker was accused of pulling out a gun at a Miami-area party after flipping over a card table. He then allegedly told Dunbar and a third person to start collecting valuables from the partygoers. A few nights earlier, Baker and Dunbar reportedly lost $70,000 while playing cards at a separate party.

Baker and Dunbar both surrendered to police after warrants were issued for their arrests, and made bond a day later. At the time they were both facing four counts of armed robbery, and Baker was facing four more counts of armed robbery with a firearm. Baker and Dunbar pleaded not guilty.

Baker’s attorney Patrick Patel has presented an alibi for his client: He was playing “Madden” at the time. Patel told the New York Post that Baker brought his own game console to the party in question and was in an entirely different room when the robbery took place. Patel said he intended to seek electronic proof that Baker was playing “Madden” at the time of the robbery.

If found guilty, Baker would face a minimum of 10 years in prison.
