Bailey was given a 25-year sentence for the French woman's death in west Cork in 1996.
The former British journalist has always denied any involvement.
Ms Toscan du Plantier's beaten body was discovered outside her holiday home near Schull in December - almost 25 years ago.
Mr Justice Barns ruled that Bailey would not be forcibly sent to France, following the European Arrest Warrant (EAW) issued in 2019.
When Bailey was convicted, he had no legal representation for the case, did not attend court and described the whole situation as farcical.
To this day, he has maintained his position that he had nothing to do with Ms Toscan du Plantier's death.
