Kesha suffers serious setback in court battle with Dr. Luke

Kesha’s public fight against Dr. Luke has been rumbling on for a number of years now, but the latest development in their ongoing legal battle proves that it’s still far from being over.

On Tuesday, Kesha suffered another serious setback in the case against her music producer, who she alleged sexually assaulted and abused her, according to a civil lawsuit filed in Los Angeles in 2014.

A New York judge has rejected the singer’s motion to file an amended complaint against Dr. Luke (real name Lukasz Gottwald), in which she again requested to be released from her record contract.

The 30-year-old pop star is said to have cited reports that Sony’s deal with Dr. Luke ends this month, telling the judge that this would only worsen her situation, as he is allegedly refusing to promote her new album.

However the judge rejected the changes, saying Kesha failed to give the required 30-day notice, adding: “It is speculative, not justiciable, whether Sony’s contract is ending and whether it will be able to assist after this month.

“Furthermore, KMI [Dr. Luke’s company] may not choose to exercise its options for future albums after the third is released.”

As part of her submission, the singer-songwriter also claimed that she was owed further royalties after Dr. Luke breached their contract, however he countered that, alleging that she actually owed him $1.3 million (£1 million).

In response, Judge Kornreich shut down the unpaid royalties argument, ruling that Kesha was not, as she claimed, performing under her current contract with Kemosabe Records and therefore “cannot maintain a breach of contract claim based on the implied covenant [of good faith].”

At the start of the year, Dr. Luke also requested to add another defamation to the lawsuit, inserting new claims that Kesha had sent an alleged text message to Lady Gaga accusing him of rape.

“Kesha asks for something far more basic: the freedom to make music without being bound indefinitely to the very producer who subjected her to years of abuse and continues that abuse to this day,” her lawyers wrote, according to The Hollywood Reporter, after accusing Dr. Luke of having a “vendetta.”

Addressing the highly publicised legal case, the judge concluded with a bizarre statement, saying: “Finally, with respect to the Prescription Agreement, signed in November 2008, Gottwald’s allegedly abusive behaviour was foreseeable.”

Kesha’s attempt to employ a Californian labor law – which argues that her contract should have been terminated after seven years, because the legal battles are taking place in the state of New York – was also rejected.
