Knife carriers, bad drivers and thieves sentenced at magistrates this week

It's the weekend and therefore time for a look at the cases that have recently come before Cornwall's magistrates. Everyone who has been charged with an offence, from the least to the most serious, appears initially before the magistrates.

The most serious cases are then sent to the crown court. If a defendant pleads guilty, they could be sentenced straight away or have the matter put back for a pre-sentence report. If they deny the allegations against them, the case will be adjourned for a trial.

The courts are open to anyone and our reporters attend just like any other member of the public. As most people have jobs and cannot spend their time in court, the media has always acted as the eyes and ears of the public to ensure that justice is seen to be done.

Here's who has been sentenced at the magistrates' court in Bodmin and Truro recently.

Kai Kiernan

Age: 19

Nanpean, St Austell

On or about July 7 at Leamingston Spa had with him, without good reason or lawful authority, in a public place Victoria Terrace an article which had a blade or was sharply pointed, namely a machete.

On August 1, at Queen's Crescent, Bodmin, had an article which had a blade or was sharply pointed, namely a kitchen knife with a blade exceeding three inches.

Suspended sentence order: two months, suspended for 12 months. Mental health treatment: 12 days. Rehabilitation activity: 20 days.

Age: 21

Longpark Way, St. Austell

On or about September 24, 2022 at Par stole cash, to the value of £200, belonging to a woman.

The next day at Par committed fraud in that you dishonestly made a false representation, namely using a debit card not in your name at the Cooperative, intending to make a gain, namely £250 for yourself and cause loss to a woman or to expose that person to a risk of loss.

On September 25, 2022 at Par committed fraud in that you dishonestly made a false representation, namely using a debit card not in your name at the Cooperative, intending to make a gain, namely £250, for yourself and cause loss to a woman or to expose that person to a risk of loss.

The next day, at Biscovey, committed fraud in that you dishonestly made a false representation, namely using a debit card not in your name at Biscovey Services, intending to make a gain, namely £51.99.

Community order. Rehabilitation activity: 13 days. Unpaid work: 100 hours. Compensation: £751.99.

Age: 50

NFA

On Saturday, January 20 at Bodmin had in your possession 0.8 grams of cocaine a controlled drug of class A in contravention of section 5(1) of the Misuse of Drugs Act 1971.

On the same day, in Bodmin, drove a motor vehicle on the A30 at Lanivet, when the proportion of a controlled drug, namely Benzoylecgonine (BZE), in your blood, namely no less than 800UGS, exceeded the specified limit of 50UGS.

On the same day and place, also drove a vehicle when the proportion of a controlled drug, namely Cocaine, in your blood, namely no less that 32UGS, exceeded the specified limit of 10UGS.

On January 31 at Plusha when the proportion of a controlled drug, namely benzoylecgonine, in your blood namely greater than 240 micrograms per 100ml blood, exceeded the specified limit.

Remanded on unconditional bail.

Adam Izdas

Age: 26

Greenbank Road, Liskeard

On March 2 in Liskeard, assaulted a woman by beating her. On March 7 assaulted the same woman in Liskeard by beating her.

Community order. Mental health treatment: 12 days. Programme - Number of days: 30 days. Rehabilitation activity: 15 days.

Paul Archer

Age: 36

St Mary's Road, Par

On March 13, 2023 at St Austell stole medication and a bank card, of a value unknown, belonging to a woman.

On March 16, 2023 at St Austell without lawful excuse, destroyed the glass window to the front door of the property to the value of £122.40 belonging to a woman, intending to destroy or damage such property or being reckless as to whether such property would be destroyed or damaged.

Community order. Programme: 30 days. Rehabilitation activity: 15 days. Fine: £120.

George Haines

Age: 42

Goonbarrow Meadow, Bugle.

On January 21, 2023 at St Austell assaulted a man thereby occasioning him actual bodily harm.

Community order. Unpaid work: 200 hours.

Billy Rowe

Age: 30

Sunnyside Cott, Menheniot

On August 24 at Liskeard drove a car at Morrisons petrol station while not having a motor insurance in place, while also being disqualified from driving and after consuming so much alcohol that the proportion of it in your breath, namely 55ug per microgrammes of alcohol in 100 millilitres of breath, exceeded the prescribed limit.

Suspended sentence order: 8 weeks, suspended period: 18 months. Programme - Number of days: 19 days. Rehabilitation activity: 10 days. Unpaid work: 80 hours. Disqualification period: 40 months.

Adam Vowler

Age: 34

St Keynes, Liskeard

Assault a person thereby occasioning them actual bodily harm. On October 14, 2023 at the Den, Pelynt, you assaulted a woman thereby occasioning her, actual bodily harm.

On the same day, damaged two necklaces to the value of £60 belonging to your victim intending to destroy or damage such property or being reckless as to whether such property would be destroyed or damaged.

Committed to Crown Court for sentence.

Jamal Imchichi

Age: 61

Gweal Pawl, Redruth

On March 31 in Redruth had in your possession 496.14 Grams of cannabis, a controlled drug of class B in contravention of section 5(1) of the Misuse of Drugs Act 1971.

On or about March 31 at Plymouth, when suspected of having driven a vehicle and having been required to provide a specimen of blood for a laboratory test pursuant to section 7 of the Road Traffic Act 1988 in the course of an investigation into whether you had committed an offence under section 3A, 4, 5 or 5A thereof, failed without reasonable excuse to do so.

On March 31 at A38, Saltash, had in your possession 0.2 Grams of cocaine a controlled drug of class A in contravention of section 5(1) of the Misuse of Drugs Act 1971.

Community order. Rehabilitation activity: 20 days. Forfeiture and destruction - Property to be forfeited and destroyed: 496.14 Grams of cannabis, Forfeiture and destruction ordered under: Section 27 of the Misuse of Drugs Act 1971. Fine: £400.

Shaun Horwood

Age: 36

The Platt, Wadebridge

On September 3, at Newquay when suspected of having driven a vehicle and having been required to provide a specimen or specimens of breath for analysis failed without reasonable excuse to do so.

On the same date in Wadebridge, drove a motor vehicle on the A39 at St Kew Highway while disqualified from holding or obtaining a driving licence. Also drove a motor vehicle otherwise than in accordance with a licence authorising you to drive a motor vehicle of that class, and also without any insurance in place.

Disqualification period: 60 months. Total custodial period: 14 weeks.
