Noisy neighbour to pay £3,000 after 'excessive shouting' from his East London home
A noisy neighbour must pay three grand after he was found to be 'excessively shouting' from his Barking home.
An East London council took him to court over nuisance music and shouting. Felix Mateus Fernande Da Cruz broke a Section 80 Noise Abatement Notice, issued by Barking and Dagenham Council’s Environmental Enforcement Officers on November 14 2023 for the 'excessive amplified music and shouting' coming from his property.
Nine months later, on August 14 2024, council officers received several complaints from neighbours about Cruz of Mill Point in Barking. Officers attended and deemed the noise coming from Cruz’s property to be 'unnecessarily loud and a breach of the Noise Abatement Notice'. He was then prosecuted at Barkingside Magistrates Court on November 5

In his absence, Cruz was found guilty and ordered to pay a fine of £1,200, costs to Barking and Dagenham Council of £1,359.14, and a Victim Surcharge of £280. The total due is £3,039.14.
The case was also picked up by the council’s Antisocial Behaviour Team on behalf of Reside and a Closure Order was issued on the property for three months on November 8. This means the premises is closed and if a person remains or enters the premises during the three-month period, they’re committing an offence and are liable to imprisonment of three months or a fine (or both) if convicted.
Councillor Syed Ghani, Cabinet Member for Enforcement and Community Safety, said: “The measures taken against Mr. Cruz underline our dedication to upholding noise regulations and safeguarding the well-being of our community. We will persist in tackling such issues.”
