Paisley brute warned he could face jail for breaching non-harassment order

A convicted domestic abuser has been warned he could be going to jail after he breached conditions of a non-harassment order.

Shivram Thaper was made subject to a two-year long non-harassment order at Paisley Sheriff Court on April 22 last year.

This order prevented Thaper, who has previous convictions including domestic assaults, possession of drugs and breaking into his ex-partner’s house, from contacting or approaching his ex-partner either directly or indirectly.

But on January 4, the 28-year-old breached this condition by turning up drunk at her workplace and phoning her demanding money.

Procurator fiscal depute Abigail McKenna told Paisley Sheriff Court Thaper and his ex-partner had been in a seven-year long relationship which ended in 2018. She explained: “On Saturday, January 4, the complainer was at her workplace in Paisley.

“The accused is aware of the complainer’s workplace and would have known she was working on this day.

“Around 1.34pm, the accused entered. His ex-partner observed the accused at the front desk area appearing intoxicated, and approached him to ask him to leave. The accused agreed to leave and the pair left around one minute later.

“The accused was intoxicated at the time and was trying to speak to his ex-partner, however, she made little sense of what he said as he was slurring his words.

“When the pair got outside, she walked away from the accused leaving him standing at the front door for a matter of minutes and thereafter leaving.

“Around 1.44pm, the complainer answered a phone call from the accused. During the call, the accused stated he wanted money back for money he had provided for a family member’s birthday.

“She terminated the call and contacted the police. Around 2.20pm, police were actioned and attended at the complainer and, at 3.55pm, police traced the accused within his home.

“The accused was arrested, and, thereafter, formally cautioned and charged. He confirmed he understood the charge and offered no reply.

“The accused was then taken to Greenock police custody where he was processed in the usual manner and held to appear at Paisley Sheriff Court on January 6.”

Defence agent Kirsty McGeehan told the town’s court Thaper appeared from custody on January 6. Bail was sought but was refused and Thaper was remanded in custody.

She added: “He was remanded and it was then he signed the section 76 letter. So, he’s indicated an early guilty plea from the offset. I think alcohol is his problem and I’d invite the court to call for reports and reserve further mitigation.”

Sentencing, Sheriff Brian Mohan said: “The incident itself sounds limited but I am going to order some background reports and you are to remain in custody and it may be that is the only option available in this case.

“It’s not the incident itself, it’s the persistence of it and only last year you broke into this woman’s house and we’re given a 14-month sentence.”

Sentence was deferred until February 17 for the preparation of a criminal justice social work report and a restriction of liberty order assessment. Thaper, described as a prisoner of Low Moss jail, Bishopbriggs, East Dunbartonshire, was remanded in custody meantime.
