Speeding motorist overturns driving ban in court (this is how he kept his licence)

A MAN has overturned a driving disqualification after appearing in court to challenge the ban.

Gerald Garland Phillips, 41, was originally banned from driving under the adding up of penalty points process and fined £1,320 after being caught speeding on two occasions at West Grinstead.

The first charge related to exceeding a 60mph speed limit on the A24 Dial Post at West Grinstead on June 7 last year, while the second offence concerned driving above the 60mph speed limit on the A24 Shipley at West Grinstead on May 27, 2021.

Phillips, of Tarring Road, West Worthing, appeared at Brighton Magistrates’ court on June 28 to make a statutory declaration against a Single Justice Procedure decision on February 3 this year, telling the court he did not receive the correct paperwork relating to the offences.

District Judge Adrian Turner said the DVLA would be informed that the the ban would no longer be in place after Phillips pleaded guilty to both offences. Two further offences of failing to give information relating to the identification of a driver were withdrawn by the court.

Phillips received six penalty points on his licence for the two offences, and was fined £120 and ordered to pay a victim surcharge of £34 and costs of £90.

At the end of the hearing District Judge Turner told Phillips: “You are no longer a disqualified driver.”
