Woman’s bid for £4.2m pub injury payout fails - but she is awarded £160,000

An HR consultant who sued for £4.2 million damages after she broke her wrist falling over at a London pub has walked away with less than £160,000 compensation.

Carmen Mazo, 44, was hurt when she stumbled over a beer garden marker rope at The Westbourne gastropub in Notting Hill in 2009.

She claimed the injury ruined her career and had a devastating impact on her mental health and claimed £4.2 million damages. But after a series of hearings before judges, Miss Mazo has now accepted £156,871.

She had been awarded that sum by a county court, but appealed to senior judges for more.

Speaking on behalf of the pub’s insurers, solicitor Paul Charter said: “The claimant has discontinued the appeal and is paying our costs.

This vindicates our client’s position that the amount she was claiming was excessive, and she was awarded a perfectly reasonable amount of damages at trial.”
