Glasgow home owner whose garden 'mistakenly' contains public land set to buy it from council

A Glasgow home owner whose garden mistakenly contains a chunk of public land is set to potentially buy the plot from the council.

The ground has been part of the garden since the Battlefield house was bought over 20 years ago as the owner wrongly thought it belonged to their property.

The space beside 8 Prospecthill Road now has a conservatory on it and measures 0.027 acres, which is equivalent to about 110 square metres.

A council paper said the owner assumed the land was part of their property as there was no clear boundary.

Explaining about how the situation arose, the paper said: "The land adjoining 8 Prospecthill Road was formed when Battlefield Road was expanded leaving behind the small wedge of land between the pedestrian walkway on Battlefield Road and the property at 8 Prospecthill Road."

It added: "This land was subsequently absorbed into the land surrounding the property at 8 Prospecthill Road after the current owner purchased the property over 20 years ago. There appeared to be no defining boundary between the subject and adjoining garden at 8 Prospecthill Road, leading the owner to assume this land was part of the curtilage of their property."

Arms length council organisation City Property is to negotiate terms and conditions over an "off market disposal" with owner Kathleen Bailley.

Councillors sitting on the contracts and property committee are to look at the matter tomorrow.

They will consider approving "in principle the off-market disposal of the subject to the owner of 8 Prospecthill Road."

They are also to decide whether to instruct the managing director of City Property to negotiate the terms and conditions of the disposal.
