The songwriters behind a Matt Cardle song from back in 2011 allege that the similarity is too great to just be a coincidence and are demanding millions in damages.

Now, the song’s performer, X Factor winner Matt Cardle has had his say, calling Ed a ‘genius’ and opting to distance himself from the lawsuit.

Matt Cardle , said: “This is not my lawsuit. I think Ed Sheeran is a genius and 100% deserves all his success.”

Songwriters behind the track ‘Amazing’, Harrington and Leonard, are working with the same lawyer who won the case against Blurred Lines last year, bagging Marvin Gaye’s family £5.3m after claiming the song was based on the 1977 song Got To Give It Up.

The case against Ed claims that Photograph and Amazing share ’39 notes’ and that the similarity between the two is ‘striking’.

It adds: “The similarity of words, vocal style, vocal melody, melody and rhythm are clear indicators that Photograph copies Amazing. The similarities go beyond substantial, which is itself sufficient to establish copyright infringement and are in fact striking.”

“Given the striking similarity between the chorus of Amazing and Photograph, the defendants knew they were infringing on a pre-existing musical composition.

“The copying is breathtaking in its deliberateness, magnitude, and hubris.

Harrington and Leonard are demanding damages of £13.8millon as well as royalties.

A spokesperson for Ed said: “We don’t comment on litigation.”
