Shannen Doherty Says Ex Kurt Iswarienko Is Waiting 'in Hopes That I Die' Before He Has to Pay Spousal Support

"It is simply not right that Kurt be permitted to prolong our divorce in hopes that I die before he is required to pay me," Doherty wrote in court documents

Shannen Doherty is hoping she receives spousal support as her monthly income decreases.

Documents obtained by PEOPLE show the Beverly Hills, 90210 alum, 53, has not yet received many of her requests for financial information regarding her ex-husband Kurt Iswarienko’s “archive” of original photography work. She claims this is delaying the process as she gets progressively more sick from her terminal cancer.

“It is simply not right that Kurt be permitted to prolong our divorce in hopes that I die before he is required to pay me while he continues to live his life and shirk his responsibilities to his dying wife of more than 11 years,” she states in the docs.

Iswarienko’s lawyer disputed this claim, saying he had offered a settlement deal in October 2023, proving he wanted to find a resolution, but Doherty denied it.  (The actress filed for divorce in April 2023 after 11 years of marriage.)

“Kurt is not ‘simply wait[ing] for Shannen to die,’” attorney Katherine Heersema stated. “He wants the best for Shannen and he wants both of them to be able to put this case behind them and move forward.”

Doherty claimed to have denied proposed settlements because they “skirted around the issues of his original works created during marriage” and “his earning capacity.”

In the filing, the podcast host is requesting $15,434 per month in spousal support from the photographer, claiming she will be losing her SAG health insurance from not working and her Charmed residuals are decreasing.

Doherty is also accusing Iswarienko of living an extravagant lifestyle while she has no access to funds, their airplane or their marital vacation home in Texas.

“Kurt has been utilizing the airplane, spending thousands of dollars at medical spas, jewelry stores, Gucci, and on flights… while simultaneously claiming he has insufficient funds with which to support me,” the filing reads.

Per documented calculations, Iswarienko’s average annual income over the past three years was $672,916 spendable. This leaves “at least” $56,076 per month spendable, of which Doherty’s lawyers state the spousal support would come out.

Those same calculations for Doherty came out to be an annual average of $259,708, which included her work in 2021 and 2022, residuals and was when she had health insurance. To date this year, Doherty claims to have made slightly over $25,000, which her lawyers say shows a significant drop in income.

She has also incurred nearly $160,000 in legal fees and is requesting Iswarienko pay $130,000 for future fees, along with $10,000 to clear the current balance she owes her attorneys.
