Woman beaters, drink and drug drivers, stalker and thief among those sentenced by magistrates

It's the weekend and therefore time for a look at the cases that have recently come before Cornwall's magistrates. Everyone who has been charged with an offence, from the least to the most serious, appears initially before the magistrates.

The most serious cases are then sent to the crown court. If a defendant pleads guilty, they could be sentenced straight away or have the matter put back for a pre-sentence report. If they deny the allegations against them, the case will be adjourned for a trial.

The courts are open to anyone and our reporters attend just like any other member of the public. As most people have jobs and cannot spend their time in court, the media has always acted as the eyes and ears of the public to ensure that justice is seen to be done.

Here's who has been sentenced at the magistrates' court in Bodmin and Truro recently.

Jack Donnelly

Age: 28

Gwindra Road, St Stephen

On February 29 at The Rann Wartha pub in St Austell had in your possession 5.99g of cannabis, a class B drug. On the same date, assaulted a police sergeant by beating him and assault a PC by beating him.

Curfew with electronic monitoring for 18 weeks.

Shay Valerie Iles

Age: 18

NFA

On May 10 at 22 Hillside Park, Bodmin, PL31 2NB breached a domestic violence protection order made by Bodmin Magistrates' Court on April 20, in that you attended [an address] in Bodmin and had contact with a person in breach of two conditions and a complaint is made for you to be liable for a penalty.

Committed to prison for one month.

Eloise Pain

Age: 20

Gear Drive, Quintrell Downs

Commission of a further offence during the operational period of a suspended sentence order made by Cornwall Magistrates' Court on April 18, for an offence of common assault of an emergency worker.

Committed to prison for five months suspended for 12 months. Rehabilitation Activity Requirement. Alcohol Treatment Requirement.

Graham Michael Smith

Age: 68

Station Road, St Mabyn

Complaint for a Stalking Protection Order on the basis that you have carried out acts associated with stalking namely sending numerous letters, a parcel, Christmas cards and a birthday card through the post to the victim, that you pose a risk associated with stalking to another person and there is reasonable cause to believe the proposed order is necessary to protect another from such a risk.

Stalking Protection Order made for five years not to have any direct or indirect contact with your victim, her husband and their children, and entering Cholsey in South Oxfordshire.

Age: 35

Park View, Liskeard

On January 13, 2023, at Landrake, drove a motor vehicle on the A38, when the proportion of a controlled drug, namely Benzoylecgonine (BZE, cocaine breakdown product) , in your blood namely not less than 265 micrograms of drug per litre of blood, exceeded the specified limit.

On the same date exceed 50 mph speed limit in contravention of a Local Traffic Order on the A38 Trunk Road (Trerulefoot Roundabout to Carkeel Roundabout, Cornwall) - in a 40mph zone.

On the same date at Landrake drove a motor vehicle on the A38 without a driving licence. On January 13, 2023, at Landrake, used a motor vehicle on the A38 without any insurance.

On April 3, 2023, at Liskeard drove a motor vehicle, on the A390 Charter Way, when the proportion of a controlled drug, namely Benzoylecgonine (BZE), in your blood, namely not less than 214 micrograms per litre of blood, exceeded the specified limit.

Warrant for arrest without bail.

Simon Sturtridge

Age: 48

Poldrea, Tywardreath

On February 9 at Bodmin, assaulted a woman by beating her.

Community order, rehabilitation activity - offender to comply with any instructions of the responsible officer to attend appointments (with the responsible officer or someone else nominated by them), or to participate in any activity as required by the responsible officer up to a maximum of: 30 Days. Fine - Amount of fine: £200.

Mitko Mitkov

Age: 35

Minorca Lane, Bugle

On Saturday February 24 at Bodmin drove a motor vehicle on Dennison Road after consuming so much alcohol that the proportion of it in your breath, namely 106 microgrammes of alcohol in 100 millilitres of breath, exceeded the prescribed limit. On the same day drove a motor vehicle on Dennison Road in Bodmin without a driving licence.

Disqualification for 26 months. Fine: £833. Driving record endorsed (no points).

Rachel West

Age: 29

Landreath Place, St Blazey

On June 9, 2023, at Par drove a motor vehicle on Eastcliffe Road, when the proportion of a controlled drug, namely Delta-9-Tetrahydrocannabinol (cannabis), in your blood namely not less than 3.1, exceeded the specified limit.

On the same day, at Par, drove a motor vehicle, on Eastcliffe Road, when the proportion of a controlled drug, namely Benzoylecgonine (cocaine metabolite), in your blood, namely not less than 100, exceeded the specified limit.

Disqualified for two years. Community order. Rehabilitation activity for 15 days.

Jo Thomas

Age: 29

NFA

On March 22 at Chough House in River Street, Truro, failed, without reasonable excuse, to comply with a direction given to you under section 35 of the Anti-social Behaviour, Crime and Policing Act 2014 in that you failed to leave the locality specified, namely Truro city centre.

Community order. Alcohol treatment for six months. 10 Days of activity requirement. Fine: £40.

Luke Hawken

Age: 41

Market Street, St Austell

On March 24 at an address in Market Street, St Austell assaulted a woman by beating her.

15 weeks suspended for two years. 30 activity requirement days including attending the Building Better Relationships. Restraining order not to go to Henver Road Newquay for three years.

Jeffrey Fogerty

Age: 34

Tregurra Lane, Truro

During March 2024 at Newquay committed fraud in that you dishonestly made a false representation, namely you applied for and obtained two credit cards in someone else's name, intending to make a gain, namely dishonestly obtaining financial credit in the name of another, for yourself.

On April 2 at Newquay stole various food and alcoholic drinks to the value of £17.03 belonging to Londis Store. On the same date, at Newquay attempted to steal money of an unknown value belonging to Sainsburys Stores.

On April 23 in Falmouth, attended Poolfield Way which you were prohibited from doing by a restraining order imposed by magistrates' court on January 16, 2024.

Sentenced to 16 weeks imprisonment.

Age: 49

Codling Close, St Austell

On April 20 in Elizabeth Road, St Austell, assaulted a police officer acting in the exercise of his functions by beating him and during the same incident, assaulted another police officer by beating him.

Community order. 20 rehabilitation activity days. Compensation: £50.

Gary McGill

Age: 60

Poundstock

On November 9, 2023, at The Crescent in Bude with intent to cause a woman harassment, alarm or distress, used threatening, abusive or insulting words or behaviour or disorderly behaviour, thereby causing that person or another harassment, alarm or distress.

On the same date, at The Beauty Salon on the Strand in Bude, with intent to cause a woman harassment, alarm or distress, used threatening, abusive or insulting words or behaviour or disorderly behaviour, thereby causing that person or another harassment, alarm or distress.

Remanded in custody until May 21 for sentencing.

James Follett

Age: 34

Gear Drive, Quintrell Downs

On July 15, 2022, at Falmouth caused serious injury to another driver by driving a mechanically propelled vehicle, namely a Peugeot Partner van on Bickland Road, without due care and attention.

12 months disqualification. Community order with unpaid work requirement to be completed within 12 months for 200 hours.

Richard Gregory

Age: 39

Lamorick Drive, Bodmin

On February 10 at Bodmin, assaulted a police officer by beating him.

Community order. Alcohol abstinence and monitoring for 120 days. 25 days of activity requirement. £50 compensation.

Alexander Farrow

Age: 38

New Street, Wadebridge

On October 4, 2023 at Bodmin, drove a car on the A38 at Bodmin Parkway without a driving licence. On the same date, drink driving, 251 microgrammes of alcohol exceeded the prescribed limit. Also drove a vehicle without insurance.

Disqualified from driving for 48 months. £250 compensation, eight weeks in prison suspended period for 12 months.

Jonathon Snelling

Age: 49

Globe Inn, Station Road, East Looe

On November 15, 2023 at Looe Railway station assaulted a woman occasioning actual bodily harm.

Community order with 30 days of rehabilitation activity requirement.
