'I can't': Driver refused drug test after cops 'smelled cannabis'

A driver refused to give a blood sample for drug testing after police "smelled cannabis" in his car.

Aaron McNair, 27, was spotted by officers driving a black Seat on the M77 just after 9pm on January 27, 2024.

Cops signalled for him to stop and approached him when they picked up on a smell of cannabis.

They searched the car and McNair was asked to provide a saliva sample, which he did.

He was arrested and taken to Helen Street police station.

There, he was asked to provide a blood sample and he refused. He said: "I physically can't, I tried."

He was cautioned and charged.

The Newmilns resident appeared at Glasgow Sheriff Court after he pleaded guilty to failing to give blood for the test.

His lawyer said: "This is his third road traffic event. There is one outstanding matter."

Sheriff Vincent Lunny said: "If you keep doing it, you will go to jail."

The solicitor replied: "He is willing to do any disposal."

The sheriff said: "These are not trivial matters. If you drive with drugs or drink in your system and you hit somebody, you are going to jail."

McNair was disqualified from driving for three years and tagged for 14 weeks, forcing him to stay indoors between 7pm and 7am each day.
