Domino's Pizza sex video: Couple convicted of takeaway romp walk free from court

A couple who were convicted of having sex in a Domino’s pizza shop while they waited for their takeaway have walked free from court.

CCTV cameras filmed Daniella Hirst, 29, and Craig Smith, 31, having sex against the counter of the Scarborough shop while they waited for their stuffed crust pizza in February this year.

On Tuesday, magistrates told the pair the offence was serious enough for them to be jailed but instead opted to give them community orders, including curfews.

The raunchy video was illegally uploaded by a Domino’s worker to the internet and garnered thousands of views.

Hirst is then seen performing oral sex on Smith, before the couple have sex leaning on the counter near to the till.

Staff continue to work in the kitchen on the other side of the counter during the couple’s antics and delivery staff come and go during the footage.

Last month the pair, from Bridlington, were convicted of outraging public decency at Scarborough Magistrate’s Court.

The pair returned to court in Scarborough on Tuesday and magistrates watched 10 minutes of the footage.

"You were both very close to going to prison," chairman of the bench Charles Davis told the pair.

He said: "It was a brazen offence, committed in a public place over a prolonged period and in the presence of staff."

Hirst, of Gypsey Road, had previously pleaded guilty while Smith, of Field Road, was found guilty in his absence after a trial that barely last 30 minutes.

The evidence in his trial consisted almost exclusively of the 18-minute film showing the pair entering the takeaway shop, ordering food and messing around with a yellow cleaning cone before engaging in the sex acts.

Scott McLoughlin, the couple's solicitor, told the court the incident happened after the pair had been drinking.

He suggested that although the sex acts had been in public, they were not "brazen".

Mr McLoughlin told the magistrates that the CCTV footage was illegally uploaded to the internet by a member of staff at the pizza store and, if it was not for this, the acts would not have been viewed by thousands of people.
