HBO has vowed to air its controversial Michael Jackson documentary Leaving Neverland despite a lawsuit being filed against the network.

The late singer's estate has sued HBO and parent company Time Warner, claiming the broadcaster "breached its agreement not to disparage Michael Jackson".

“The Jackson Estate will seek all damages proximately caused by HBO’s reprehensible disparagement of Michael Jackson, which could exceed $100 million should HBO succeed in the damage it is intending to cause to the legacy of Michael Jackson,” began the complaint filed at the Los Angeles Superior Court today (February 21).

“HBO breached its agreement not to disparage Michael Jackson by producing and selling to the public a one-sided marathon of unvetted propaganda to shamelessly exploit an innocent man no longer here to defend himself.”

However, HBO will go ahead and broadcast the documentary – which recounts sexual abuse allegations made against Jackson – as planned.

“Despite the desperate lengths taken to undermine the film, our plans remain unchanged,” said the network in response to the filed complaint. “HBO will move forward with the airing of Leaving Neverland, the two-part documentary, on March 3rd and 4th. This will allow everyone the opportunity to assess the film and the claims in it for themselves.”

Jackson's estate had previously condemned the documentary after its Sundance premiere shocked viewers.

HBO released the first trailer for the film this week, ahead of its US and UK premiere next month. Digital Spy has reached out to Channel 4 to confirm that it still plans to show it.

The preview features home video footage filmed at Jackson's Neverland Ranch, interspersed with commentary from Wade Robson and James Safechuck, who have both alleged they were abused by the singer as children.

Leaving Neverland will air on Channel 4 in the UK on Wednesday, March 6 and Thursday, March 7.
