Nuneaton council issues statement over wildlife sanctuary court appeal victory

Nuneaton and Bedworth Borough Council has said it is 'disappointed' over the loss of a court battle with the Nuneaton and Warwickshire Wildlife Sanctuary. CoventryLive yesterday revealed that the Oaston Road-based animal haven won its court appeal with the local authority.

The borough council had issued the sanctuary with an abatement notice in relation to an animal odour complaint but they decided to appeal it in court. A Birmingham Magistrates Court judge ruled in their favour.

Now a hearing will be held on July 9 to discuss costs. It is already known that the sanctuary had to fund-raise to pay the near £30,000 to mount the legal action.

The council has issued a statement following the court decision yesterday and in it, it speaks of its 'disappointment. But is also recognises the sanctuary's 'significant community work' and says it aims to now build a 'productive relationship' with the sanctuary.

The statement in full reads: "Nuneaton and Bedworth Borough Council is disappointed to learn of the outcome handed down by the judge on the appeal and will now consider the judgement and reflect on the decision.

"The authority has a statutory duty to carry out investigations in response to complaints received and did so in this instance with utmost good faith.

"However, the decision made has been accepted by the council, we acknowledge the sanctuary's significant community work and look to build a productive relationship moving forward."
