Man failed to identify driver of van that mounted pavement to pass refuse lorry

AN ISLE of Wight man failed to identify the driver of a van which mounted the pavement to pass a refuse lorry.

Peter Barrett, of Gort Road, East Cowes, appeared before Isle of Wight magistrates on Tuesday, June 25.

The 41-year-old admitted failing to give information relating to the identification of the driver of a vehicle when required, on April 8.

A further charge of driving without due care and attention, in Niton, was dismissed.

Prosecutor, Liz Miller, said police had been alerted to an incident involving a stationary refuse lorry.

The court heard a Ford transit van mounted the pavement to pass the lorry with workers in situ, causing a danger of collision.

Ms Miller said police wanted to find out who the driver of the vehicle was, and Barrett was issued a section 172 notice.

Tom Cooke, defending, said it was difficult for Barrett to recall whether he had been driving and the vehicle had been hired by his employer.

He said it took time for evidence to reach him, and he was initially sent still images.

Mr Cooke said Barrett was unable to identify the driver, and by the time he saw the video footage, it was too late.

The court heard the mandatory six points on his licence would make it difficult for him to keep his job.

Barrett was fined £233, and his driving record was endorsed with six penalty points.

He must pay costs of £85 and a £93 surcharge.
